I agree that I am using Manulife Chatbot which provides pre-defined information and assists with my policy inquiry and request. It is not intended to offer specific financial, legal, medical or insurance advice. I acknowledge that Manulife can, at its sole discretion, and, with or without notice or reason, determine, modify, change, vary, suspend, postpone, terminate, discontinue, impose and/or prescribe any time and from time to time the scope and the type of the information and service to be made available in Manulife Chatbot. In the event that Manulife Chatbot is temporarily unavailable for any reason whatsoever, Manulife shall not be liable, and I agree to use other available means to communicate with Manulife via email or phone call.
I agree to comply with requirements in order to use Manulife Chatbot in the manner specified by Manulife from time to time in order to protect the confidentiality, integrity and availability of personal data. I accept full liability and responsibility for the consequences arising from or in connection with my use of Manulife Chatbot and agree to hold harmless and indemnify Manulife from any liabilities, claims or damages arising from my breach or violation of these terms and conditions.
By using Manulife Chatbot, I acknowledge and agree that I have read, understood and accepted to be bound by these Terms, as may be revised and updated by Manulife from time to time. I understand that this Terms of Use constitutes a legal agreement. If I do not agree to these Terms, I will not use Manulife Chatbot.
The term “I” as used herein refers to the individual policyowner of MP or MCBL or the non-MP or non-MCBL individual policyowner who uses Manulife Chatbot.
I agree to pay for any cost and expense to obtain and maintain or configure suitable software, device and/or equipment to use Manulife Chatbot. I agree that none of Manulife’s employees, agents, sales associates or representatives can accept appointment as my agent to access, use and/or operate the Manulife Chatbot for and on my behalf.
I fully understand that the Manulife Chatbot service is provided on an "As Available" basis without warranty or condition of any kind, expressed or implied. I further understand and agree that Manulife does not make any warranty that the use of the Manulife Chatbot will be continuous or uninterrupted.
I understand that my inquiry or request will be submitted to Manulife through Manulife Chatbot. I agree that any requests made through the Manulife Chatbot are subject to review and processing by Manulife staff. Submission of a request does not guarantee fulfillment. The Manulife staff can contact me for further information or clarification, during business hours, through the mobile phone number and/or email address I provided to Manulife. I agree to provide at all times to Manulife, through the Manulife Chatbot, accurate, complete and up-to-date contact details. I represent and warrant that my use of the Manulife Chatbot will comply with the terms and conditions stated herein and shall not be used in any unlawful or discriminatory activities. In addition, I will not permit or allow any other person to use my account in connection with an illegal purpose or activity. In the event of any unauthorized use of my account, I shall immediately notify Manulife through +632 8 884-7000 about such illegal use.
I fully understand that while MP or MCBL strives to provide accurate and up-to-date information, the Manulife Chatbot's responses are based on the data available from the policy account records at the time of the interaction. For more detailed advice or information about the policy(ies), I will contact my MP advisor or MCBL sales associate. By using the Manulife Chatbot, I, as MP or MCBL policyowner, agree that in the event that Manulife is unable to fulfill the required customer due diligence (CDD) measures, as mandated under the Anti-Money Laundering Act, as amended and relevant issuances, due to my fault, Manulife may apply the following: (a) measures to restrict the services available or prohibit any further transactions on the contract/policy until full and proper CDD measures have been successfully conducted; and (b) in case the foregoing is unsuccessful, terminate business relationship, which shall only entitle me to receive the unused portions of premium or withdrawal value, if any, whichever is applicable. I also agree to be bound by obligations set out in relevant United Nations Security Council Resolutions relating to the prevention and suppression of proliferation financing of weapons of mass destruction, including the freezing and unfreezing actions as well as prohibitions from conducting transactions with designated persons and entities.
The information I provided during my interaction with Manulife Chatbot can be recorded and used by Manulife or its third-party service provider for training and quality assurance purposes, to improve Manulife’s services and if necessary, as evidence in any legal proceedings. I fully understand that MP and MCBL, including their employees, directors, officers, agents or representatives, are not liable for any direct or indirect damages arising from the use of the Manulife Chatbot, including but not limited to, errors in information, delays in processing document requests, or unauthorized access to user data.
I understand that Manulife shall endeavor to take reasonably practicable steps to ensure Manulife Chatbot has adequate security designs to control and manage the risks in its operation and that Manulife shall under no circumstances be liable for any failure of Manulife Chatbot in whole or in part or for my inability to use it due to circumstances either outside or within the control of Manulife.
I understand that Manulife shall endeavor to take all reasonable steps to ensure that any information made available by Manulife Chatbot is correct and updated at regular intervals. I agree that Manulife shall not be held liable for any loss suffered by me in connection with the accuracy, completeness, authenticity or timeliness of any information I received via Manulife Chatbot.
Without prejudice to the generality of these Terms, I agree that Manulife shall not be liable for any harm, loss (direct / indirect / consequential / contingent / special) (foreseeable or not) or damage (whether arising in contract, tort, negligence), or otherwise that may arise from the use of information and any services provided under Manulife Chatbot at any time and from time to time. I further waive all rights that I may have to hold Manulife responsible, liable or otherwise accountable in connection with my use of Manulife Chatbot. I agree that such exclusions of liability are fair and reasonable, and that Manulife would not have permitted my use of Manulife Chatbot without my agreement with the liability exclusions and disclaimers set out herein.
MP and MCBL are committed to protecting the personal data that I have provided. By clicking the “I Agree. Get Started” button below and continuing to use Manulife Chatbot, I agree that the information I provided (including the information of third parties, who have provided their consent) and any subsequent changes to it can be processed, shared, disclosed, transferred or used by the Company (including its shareholders, directors and employees, affiliates, subsidiaries, any member of the Manulife Financial Group, representatives, industry associations, local and foreign authorities having jurisdiction over companies within the Manulife Financial Group), external auditors/counsels, and by any of its third party service provider(s) (regardless of where they are located or registered) for the purposes for which they were collected, other purposes I consent to or as required or permitted by law, for servicing my request and administering my policy(ies) and for the purposes stated in the Company’s Customer Privacy Policy and Notice found in the Company’s website https://www.manulife.com.ph/Customer-Privacy-Policy (for MP) and https://www.manulife-chinabank.com.ph/Customer-Privacy-Policy (for MCBL).
I understand that no act, delay or omission by Manulife shall affect its rights, powers and remedies under these Terms or any further or other exercise of such rights, powers and remedies. The rights and remedies under these Terms are cumulative and not exclusive of the rights and remedies provided by law.
The Manulife Chatbot and these Terms shall be governed by the applicable laws of the Republic of the Philippines. I hereby consent and agree to submit to the exclusive jurisdiction of the courts of Makati City, Philippines in any action or proceeding instituted under or related to this Terms or my use of this Manulife Chatbot.
I agree that if any part of these Terms is held to become illegal, invalid or unenforceable in any respect under the laws of any jurisdiction, the unenforceable part shall be given effect to the greatest extent possible and the legality, validity and enforceability of the remaining provisions shall remain in full force and effect.
I agree that Manulife shall be entitled to revise and/or add to these Terms at any time and from time to time. The revised and/or additional terms and/or conditions shall become effective when displayed, advertised or brought to my attention by any other means as Manulife thinks fit, and shall be binding on me if I continue to use the Manulife Chatbot after the effective date thereof. Any amendment of these Terms shall not affect Manulife’s or my accrued rights or liabilities.
I understand that all content, materials, software, designs, trademarks, logos, and any other intellectual property related to the Manulife Chatbot, including but not limited to text, graphics, images, and other media (collectively referred to as "Intellectual Property"), are the exclusive property of Manulife, and are protected by applicable intellectual property laws, including copyright, trademark, and patent laws.
I agree not to reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Intellectual Property without the express prior written consent of Manulife, as applicable. I shall not use Manulife Chatbot in any manner that infringes upon the intellectual property rights of Manulife. I understand that any unauthorized use of the Intellectual Property may result in legal action, including but not limited to claims for infringement, damages, and injunctive relief. The rights granted to me under these Terms are limited to those necessary to use Manulife Chatbot in accordance with the terms and conditions set forth herein, and do not transfer any ownership rights in the Intellectual Property. All rights not expressly granted to me under this agreement are reserved by Manulife.
I confirm that the information I provided to Manulife is complete, correct, accurate and true based on my personal knowledge and official records. I also allow Manulife to update my records based on the verified information I submitted to the Company and to use such to service my request and/or administer my policy(ies).
When you use the Manulife Philippines or Manulife China Bank (“Manulife PH”, “MCBL” “us”, “we”), public website to chat with us, we act as the personal information controller of your data. By engaging in chat and providing your personal data and any subsequent changes to it (including the information of third parties), with the consent of the individual concerned, you provide consent to Manulife PH or MCBL, its employees, and third-party service providers processing this data. This processing is for the purposes of verifying your and other individuals’ identity, providing support and assistance, responding to customer support inquiries or requests, processing policy-related transactions, and analyzing the usage of our chat services.
